Tougher penalties for repeat small theft

For theft cases under this $500-or-less rule or an equivalent local ordinance, penalties rise for repeat offenses. A second or third offense within three years is a class A misdemeanor. A fourth or later offense within four years is a class C felony. These rules apply to repeat violations of the same small‑theft paragraph.

Grading and sentencing notice for small theft

A first theft of property or services worth $500 or less is a class B misdemeanor in two situations. It applies if the theft is shoplifting, or if all three are true: not by threat; not by deception by someone in a confidential or fiduciary role; and not by a public servant or bank employee acting on the job. Prosecutors can charge it this way, or a judge can apply it at sentencing if the needed facts are proven by a preponderance of the evidence. At sentencing, the court must give a written notice about any enhanced penalties for later offenses under this section.
