Agencies must cite legal authority

When a state agency enforces a rule, it must cite the exact statute or rule that gives it authority. This citation must be in notices, orders, determinations, and similar actions. This helps people see the legal basis for the agency’s decision.

Stronger checks on agency rule enforcement

If an agency exceeds its legal authority, or a court does not affirm its decision under section 28-32-46, the agency must report it to the Governor’s office. Anyone can also report a violation of this law to the Governor’s office. The Governor’s office must investigate and may issue a written warning, require an improvement plan, or terminate employment. The office must keep records of every report and any actions taken. Each year it must report to the Administrative Rules Committee which agencies had reported violations and how many. If the committee asks, the office must provide copies of its records.
