AN ACT to create and enact a new chapter to title 23.1 of the North Dakota Century Code, relating to onsite wastewater treatment systems; to amend and reenact sections 23-35-02 and 23-35-08 of the North Dakota Century Code, relating to the powers and duties of the boards of health and public health units; to repeal sections 23-35-02.2 and 23-35-02.3 of the North Dakota Century Code, relating to the onsite wastewater recycling technical committee; to provide for a legislative management report; to provide a penalty; and to provide an appropriation.

New statewide rules for septic work

Installers and servicers must be licensed by the state board. All permits, renewals, inspections, and work must follow the board’s rules and standards. Local public health units cannot issue septic permits, do inspections, or oversee installations. The board also cannot hire health units to do inspections. Doing this work without the required license is a class B misdemeanor. The law also repeals the former onsite wastewater recycling technical committee.

Appeal septic permits and licenses

If the board denies, changes, or revokes your septic permit or license, you can appeal to the Department of Environmental Quality. You must file within 10 days after you get the board’s notice. The department reviews the decision and can order the permit or license if it was wrongly denied or revoked.

Statewide public health units and services

Every place in North Dakota is inside a public health unit. Each unit must offer basic services, like disease control, injury prevention, environmental health, and care for mothers, children, and families. Units also work to help people access clinical care.
