Joint boards required for multi-county water projects

The law requires water resource districts to form a joint board before building or assessing a project that spans or benefits more than one county. The joint board has the same powers as a single district board. If districts do not agree to join, one district may proceed for projects in the major drainage basins named in law, after notifying the joint board and filing the required engineer’s report. The joint board moves ahead only if it finds the project is needed and benefits exceed costs, then follows the standard steps to create an assessment district, set assessments, and issue special warrants. If the assessment vote passes, the joint board must build, own, operate, and maintain the project and run the assessment district. Property owners in the district may have to pay assessments.
