The Industrial Commission sets who is a qualified oil and gas lease applicant on state lands. Before awarding a lease, the Commissioner checks the high bid to confirm the bidder is qualified. If the top bidder is not qualified, the second-highest bidder can get the lease. The second bidder must agree to pay the lower of two amounts. It is either the highest bid before the disqualified joined, or the second bidder's own bid. A bidder rejected for not being qualified owes a civil penalty equal to the bidder's highest bid. The Attorney General can sue to collect the penalty.
