No garnishee judgment under $40

Courts cannot enter a judgment against a garnishee when the defendant’s judgment is under $40, not counting costs. In that case, the garnishee is discharged.

Higher garnishment fees, optional e-service

The law sets the garnishment disclosure fee at $40, up from $25. Plaintiffs must give the garnishee $40 when they serve the garnishee summons. When the State is the garnishee, service is made on the Office of Management and Budget. The $40 fee is paid to OMB and deposited in the state treasury. The OMB director may offer an optional electronic service. Filings sent that way do not owe the fee.
