The law sets a spending cap equal to 7% of the Legacy Fund’s five‑year average value. The average uses year‑end values through the most recent even‑numbered fiscal year. On July 1 of odd‑numbered years, money moves in order: up to $102,624,000 (or the debt service amount) to the sinking and interest fund; $225,000,000 to the general fund for tax relief; $100,000,000 to the highway fund; $25,000,000 to the emergency services fund; then any remainder split half to the general fund and half to the strategic investment fund. If Legacy Fund earnings land in the general fund at biennium’s end, the treasurer moves them back to the legacy earnings fund. If scheduled transfers exceed the amount available, the excess is also split 50/50 between the general fund and the strategic investment fund.
The law creates a Legacy Earnings Emergency Services and Public Safety Fund. The fund holds deposits set by this act and its interest. Money is always available to the Department of Emergency Services to make grants and cover admin costs. An advisory board with members from fire, EMS, police, counties, cities, tribes, and lawmakers ranks and awards grants. Political subdivisions and tribal governments, including rural fire districts and EMS providers, can apply. Grants must focus on staffing, shared services, faster response and pilots, modern service models, mental health response teams, and needed tech and communications, plus help finding other funding.
