The law creates a way to move property between neighboring school districts by exchanging parcels. To file, you must live on the property and get one qualified voter from each home there to sign in writing. The owner of the matched property in the other district must also give written permission, even if they do not live there. Each property must touch the district it will move into. The two districts must agree on the taxable value difference. Exchange petitions still must follow all other annexation laws.
The state board gives final approval on annexations and can skip its own hearing in uncontested cases by using the county record. You may appeal a county decision to the state board and then appeal the state board’s decision to the district court where the property is. For multi‑county cases, the county with the major portion handles it, or committees with major portions in each district hold a joint hearing and vote separately. If the state board denies an annexation, you must wait 3 months to refile, and the board cannot consider the same property more than twice in 12 months.
After a petition is filed, the county superintendent must schedule a public hearing and give notice. Owners get certified mail at least 21 days before the hearing, and a notice is published at least 14 days before. Before the hearing, the county committee must count residents who can vote and confirm two‑thirds signed the petition. At the hearing, the committee must hear evidence on property values, district debt and bond levies, taxes, schools, travel and barriers, student welfare and opportunities, possible savings, and how taxes for owners might change. The committee must issue written findings and approve or deny, and if approved, send the full record to the state board.
