Tighter rules for suing the state

The law limits when you can sue North Dakota. The state is liable only if a state employee’s negligence within their job, or the state’s tangible property, caused the injury. You cannot bring claims unless this chapter or the Legislative Assembly allows them. Many acts are immune, including discretionary, legislative, and judicial acts, injuries caused by non‑employees, and routine public duties like inspections, parole, and ordinary law enforcement. Punitive or exemplary damages are not allowed, and protective laws do not by themselves create a duty. These rules apply through July 31, 2027.

Damage caps and payment rules through 2027

The law caps state payouts. Before July 1, 2023, the cap is $375,000 per person and $1,000,000 per occurrence. The caps then rise on set dates: July 1, 2023 ($406,250 and $1,625,000); July 1, 2024 ($437,500 and $1,750,000); July 1, 2025 ($468,750 and $1,875,000); and July 1, 2026 ($500,000 and $2,000,000). Any judgment above the cap is paid only if the Legislative Assembly approves money; you can give the judgment to the budget director, who must request payment in the next regular session. After July 31, 2027, lower caps of $250,000 per person and $1,000,000 per occurrence apply.
