Small purchases can skip bidding

The OMB director can set a dollar limit in writing. Purchases under that limit do not use the full procurement process. The director can also name specific items or services that are exempt.

Streamlined purchasing for common needs

Some buys can skip the full procurement steps. These include land, buildings, and rentals; telephone and electric power; and public books, maps, and technical pamphlets. The Transportation Department may use its own process under existing law. Energy program purchases by the Industrial Commission are exempt under listed laws. Agencies may also hire the manufacturer or an authorized agent to service equipment when that is best for the state.

Targeted buying exemptions for state programs

Certain program contracts are exempt from the procurement chapter. Examples include fiduciary benefit and investment services (not perpetual), services to remove abandoned or submerged vehicles, and listed Agriculture Commissioner contracts. State Auditor IT audit contracts, Attorney General expert contracts, and specific DHHS mental health training and brain injury supports are also exempt. The education department can contract with regional education associations under this exemption.

More services from regional education associations

Regional education associations must offer key services to get state funding. They provide training for teachers and principals, added tech support, help with school improvement goals, help using student data, and help expanding classes. Associations may also offer extra services and serve nonmember districts. They can sign contracts with the state superintendent to deliver these services.

Centralized state purchasing and compliance

The Office of Management and Budget handles buying and leasing for executive-branch agencies. The International Peace Garden may use this process. All OMB and delegated agency purchases must follow the procurement chapter, rules, and OMB policies.

Faster emergency buying with safeguards

Agencies can skip normal bidding in true emergencies when time limits block action and health, safety, or state services are at risk. They must treat bidders fairly and promote competition when possible. They must put written reasons in the file explaining the emergency and why the contractor was chosen, including for noncompetitive buys. If federal reimbursement is available, they must follow federal rules and keep the right paperwork. For goods, they may require samples to test quality when time allows.
