Device and OS makers verify age

Beginning August 1, 2026, device, operating system, and app store makers must check the primary user’s age at activation. They must send a real-time signal that shows if the user is under 18 or 18 and older. Makers must add this feature in OS updates for devices sold before August 1, 2026, if they still support them. They must hold partners to the same rules and cannot use age-check data for any other purpose. If they take commercially reasonable and technically feasible steps, they are not liable under this law.

News and internet providers exempt

Beginning August 1, 2026, bona fide news and public-interest reporting are not covered, and news-gathering rights remain. Internet service providers, search engines, and cloud providers are not liable just for access or storage if they did not create the mature content.

Sites with adult content block minors

Beginning August 1, 2026, sites and apps must read the age signal. If more than one-third of their material is mature content, they must block under-18 users, warn that the site has mature content, and label it for adults. If mature content is less than one-third, they must block known mature items for under-18 users and show a warning.

State attorney general enforcement and $10,000 fines

Beginning August 1, 2026, only the North Dakota Attorney General enforces this law and may issue rules. If the Attorney General alleges a violation, the maker has 45 days to fix it and send a written statement. Ongoing or uncorrected violations can lead to actions and a $10,000 fine per violation. The law does not create a private right to sue.
