Quicker licensing, temporary permits, clear appeals

Boards must issue a license within 17 business days for a complete, routine application. This deadline does not apply to applications handled through interstate compacts or transfer agreements, which must still be processed quickly under those rules. Boards may let staff or selected members issue provisional or temporary licenses between meetings for routine, complete files. Applications must be available online. If a board requires a North Dakota law exam, it must offer it at least monthly and may limit attempts. If your license is delayed, you must first seek a fix with the board; if not resolved, you can bring it to the governor’s office, and boards must post how to contact that office.

Simpler licensing for out-of-state workers

If a board is not in an active interstate compact or transfer deal, it must license qualified out-of-state professionals. You must have used your license two of the last three years and show the education and skill the board requires. You cannot be under active investigation, have discipline in the last ten years, or have disqualifying conduct unless the board waives it. You must pay board fees and submit state and federal background checks if the board requires them. The state board of law examiners may use a character and fitness review instead of the background-check rule.

Boards review interstate compacts yearly

If a board is not already in an effective interstate compact, it must review available compacts each year and decide if joining helps the profession. The review must appear on the board’s agenda and in its minutes. If the board decides not to join, it must send the compact and its reasons to the labor commissioner.

Online CE and more board help

You can complete required continuing education online for license renewal unless another law, rule, or national standard requires in-person hours. Boards may provide education or resources to people entering the field and to current licensees. The Department of Labor and Human Rights must keep a website with board resources, staff and member contacts, and a message board on licensing best practices.

Governor appoints and can remove members

Unless another law says otherwise, the governor appoints board members and may remove them for cause, misconduct, incapacity, or neglect of duty. When a term ends, a member may keep serving until the governor names a replacement.
