The law creates "military impact zones" around each base. Zones extend from the base boundary and must be 5 to 25 miles wide. Set distances: Grand Forks AFB 25 miles; Minot AFB 25 miles; Camp Grafton (South) 5 miles; Cavalier Space Force Station 15 miles. A compatible use study sets the final outer line and considers each base’s mission. The law also defines "encroachment," including noise, new development, airspace or radio use, and urban growth that can harm testing, training, or operations.
The law creates a Military Compatibility Commission. Members include the Governor or designee, one Public Service Commission member, a representative from each county, township, and city in a zone, and one member chosen by the North Dakota League of Cities. Base commanders may join voluntarily. The commission sets zone boundaries based on each base’s mission, reviews development proposals in the zones, and serves as a liaison for encroachment issues. It also sets a uniform process for local governments to coordinate with the U.S. Department of Defense Military Aviation and Installation Assurance Siting Clearinghouse on zoning, construction, energy, telecom, and other projects that could affect radar, airspace, communications, or readiness, following state chapters 11-33, 40-47, 40-48, and section 58-03-12. This gives communities clearer protection, and it adds a required coordination step for projects in these zones.
