The law clarifies what counts as medical cannabis for patients. Hemp (as defined in the Nebraska Hemp Farming Act), mature stalks, fiber, oil or cake from seeds, sterilized seeds, and FDA‑approved CBD drugs do not count. This reduces legal risk and confusion for patients and caregivers in the medical program.
The law clarifies what counts as cannabis for registered medical cannabis businesses. Hemp (as defined in the Nebraska Hemp Farming Act), certain plant parts, and FDA‑approved CBD drugs are not treated as cannabis under the medical program. This reduces the chance that hemp or those drugs are regulated as medical cannabis.
The law repeals the old Section 2 text in both 2024 medical cannabis initiatives and replaces it with corrected definitions. It declares an emergency, so these changes take effect immediately upon enactment. This makes the corrected terms enforceable right away.
