Medical cannabis patients: access and limits

You are a qualified patient if you are 18 or older with a written recommendation from a licensed doctor, physician assistant, or nurse practitioner. If you are under 18, a parent or legal guardian must also give written permission. A recommendation lasts up to two years, unless the practitioner sets a shorter time. Adult patients can name a caregiver who is at least 21 in a signed affidavit; parents or guardians can serve as caregiver for minors or name someone in a sworn affidavit. A health care facility or home health agency can serve as a caregiver if it agrees in writing. Patients and caregivers can possess up to 5 ounces of cannabis. The 5‑ounce limit does not count the weight of other ingredients in edibles, drinks, or topicals.

New rules for cannabis businesses

The law defines "cannabis for medical purposes," "cannabis products," and what a "registered cannabis establishment" is. Businesses that grow, make, deliver, or sell medical cannabis must register with the Nebraska Medical Cannabis Commission. The law also defines "cannabis accessories" broadly, covering equipment for growing, processing, testing, packaging, storing, vaporizing, and using cannabis. This clarity helps you know what you can make or sell, but more items now fall under cannabis rules and may require more compliance steps.

Hemp excluded, changes take effect now

The law states that "cannabis" does not include hemp under Nebraska law. It also keeps exclusions for mature stalks, fiber, seed oil or cake, sterilized seed, and FDA‑approved CBD drugs. It repeals the old Section 2 text in both voter‑passed medical cannabis laws and replaces it with updated definitions. The law takes effect immediately upon approval.
