The law updates what counts as an adult day service. It covers community programs that give care and social or medical help for less than 24 straight hours. The program must serve four or more people who need or ask for help because of age or functional limits. It excludes community-based waiver services run by certified specialized programs under the Developmental Disabilities Services Act and services at a PACE center (Program of All-Inclusive Care for the Elderly). Those excluded programs are not licensed as adult day services under this law.
An emergency clause makes the law take effect immediately. Providers and people using services must follow the new definition and exclusions now.
