Starting July 1, 2027, money no longer transfers out of the Affordable Housing Trust Fund. The Rural Workforce Housing Investment Fund ends July 1, 2027; any money left moves to the General Fund. The Middle Income Workforce Housing Investment Fund ends July 1, 2029; any money left moves to the General Fund. The Department of Economic Development also creates a subaccount inside the Middle Income fund to pay for affordable housing and land preparation under the Economic Recovery Act.
Real estate transfers pay a documentary stamp tax of $2.32 for each $1,000 of value. Round the price up to the next $1,000 to figure the tax. This replaces the prior $3.00 rate, lowering closing costs. Before January 1, 2032, the register of deeds keeps $0.50 per transfer. The rest is credited per transfer: $0.95 to the Affordable Housing Trust Fund; $0.25 to the Site and Building Development Fund; $0.25 to the Homeless Shelter Assistance Trust Fund; $0.30 to the Behavioral Health Services Fund; $0.07 to the Domestic Violence and Sex Trafficking Survivor Housing Assistance Fund; and $0.50 each to the Rural Workforce Housing Investment Fund and the Middle Income Workforce Housing Investment Fund. On or after January 1, 2032, the two $0.50 credits to the Rural and Middle Income funds end. The other credits and the $0.50 kept by the register remain. For property reporting, a transfer counts as a sale if the stated price is over $100. Before January 1, 2032, paying more than $2.32 in stamp tax also makes it a sale; on or after that date, paying $2.32 makes it a sale. The law repeals and replaces prior sections with these rules.
