Special-needs nursing care stays out of managed care
The law keeps skilled nursing and nursing facility care for Medicaid long-term care clients with special needs out of managed care. These services stay in fee-for-service or another system allowed by law. The state can have managed care plans help coordinate other benefits or wraparound services, but plans cannot take provider financial risk or control provider utilization. Providers cannot be forced to join a managed care plan to serve these clients. A special-needs client is someone whose medical or nursing needs are complex and exceed usual nursing facility care.
Medicaid contracts updated; long-term care pause in 2023
Until July 1, 2023, the state does not add long-term care services to Medicaid managed care. This covered skilled nursing, nursing facilities, assisted living, and home- and community-based services. The department must update managed care contracts and enrollment processes within six months after this law takes effect. The department can write rules to carry out these changes. The prior version of section 68-994 is repealed, and the new rules replace it.
