Patients must consent to intimate exams under anesthesia

The law bans providers from doing intimate exams on anesthetized or unconscious patients in a health care facility without prior written consent. The only exceptions are written consent from an authorized decision-maker, an emergency need for diagnosis or treatment, or a court order. If an exam happens under an exception, the facility must give the patient written notice before discharge. Violations can lead to discipline under Nebraska’s Uniform Credentialing Act. An “intimate examination” means a manual breast exam or an internal pelvic, prostate, or rectal exam; visual-only checks are not included.
