Stronger protections for private power projects

Consumer-owned utilities, like public power districts and city utilities, cannot use eminent domain to take privately developed renewable projects that meet section 70-1014.02. The law also protects a private plant built to serve one industrial site with new load over 1,000 megawatts if key rules are met. The plant must be on or next to the customer, use an equivalent interconnection point, and have Nebraska Power Review Board approval. The parties must sign a long-term deal that keeps the utility’s retail rights, bans resale by the customer, and waives eminent domain for the contract term; the utility’s governing body must approve it. The industrial customer pays all related costs, fees, congestion charges, and grid upgrades, and the plant serves only that customer unless the utility approves a waiver. These large-load contract rules apply to new-load deals signed on or before December 31, 2031.

New eminent domain rules for public utilities

Public power districts in Nebraska can use eminent domain to take property used to make, move, or deliver electricity, following the state’s condemnation process. If a district asks, the Attorney General represents it; after taking an existing electric system, the district must repay the state’s legal costs. A district may choose to use eminent domain only for wind power projects, limiting its use by policy choice.
