The board can start investigations on its own or after a complaint. It can suspend or revoke an appraiser’s credential, stop education courses, deny applications, or issue cease‑and‑desist orders. The board must report discipline that limits practice to federal authorities under Title XI. A successfully completed contingent dismissal agreement is not treated as discipline for that reporting.
The board can censure, suspend, or revoke an AMC’s registration and fine up to $5,000 for a first offense and up to $10,000 later. It must weigh the violation, try less severe steps first, and consider your compliance program, quick fixes, and self‑reporting. The board reports AMC violations and discipline to the Appraisal Subcommittee. The board can use contingent dismissal agreements that require fixes; if completed, they are not treated as discipline for federal reporting.
You must register before you offer or advertise appraisal management services in Nebraska, unless you meet federal AMC rules. The board can treat unregistered actors as AMCs for jurisdiction and issue cease‑and‑desist orders. Orders become final after 10 days unless you request a hearing. The Attorney General can take the case to district court to enforce the order.
People whose appraiser credential was refused, denied, canceled, revoked, or surrendered for a substantive cause cannot own an AMC. No more than 10% of an AMC can be owned by someone not of good moral character. Each owner with more than 10% must submit fingerprints and complete state and FBI background checks. The board pays the fingerprint check fees. If a prior credential was reinstated and not for a substantive cause, that person is not barred from ownership.
