Schools cannot access personal device data

The law does not allow schools to monitor, collect, or access information on phones or other devices that the district does not own or provide for academic use. This protects the privacy of students and families using personal devices at school.

New school rules on student devices

The law requires every public school board to adopt a student device policy before the 2025-26 school year. The policy must be written with input from students, parents, and educators. Except for listed exceptions, it must ban student use of phones and other electronic communication devices on school property and at instructional functions. Allowed uses include when required by an IEP or 504 plan, for district-approved class work, during an emergency or perceived threat, for health monitoring, or when allowed by the board or an appropriate employee. Discipline or limits on access are allowed only if included in district rules adopted under state law (section 79-262).

Law takes effect immediately

The act takes effect when it is passed and approved under state law. The requirements are now in force, with the policy deadline before the 2025-26 school year.
