Drugmakers can't block discounted 340B drugs

Drug makers, their agents, and logistics providers cannot block a 340B provider from buying or receiving discounted drugs. They cannot deny delivery to any location the provider authorizes, unless federal law bans receiving the drug. They also cannot require extra claims, medical, or purchasing data as a condition to ship, unless federal law requires it. This protects low-income, uninsured, and Medicaid patients who rely on these discounts.

State can sue to enforce 340B access

The Nebraska Attorney General or any county attorney can sue in the state's name to stop violations of this law. They can ask a court for an injunction or other orders to prevent the violations. This helps keep discounted 340B drugs available when companies break the rules.

Defines who and what 340B covers

The law defines a '340B drug' and a '340B entity' by federal law as it stood on January 1, 2025. It also uses Nebraska's existing definition of 'manufacturer.' These definitions set who is covered by the protections.
