State debts taken from device winnings

Before paying cash-device winnings, distributors must check the state’s collection system. They must deduct unpaid state taxes and other state debts. They send those amounts to the Department of Revenue. The winner gets the rest. This begins when the Tax Commissioner sets the start date.

Tighter screening and enforcement for device licenses

Applicants and license holders must complete a one‑time background check with FBI fingerprints through the Nebraska State Patrol. You must file a personal history report and may be inspected. You pay these costs. The Tax Commissioner can deny, suspend, or revoke licenses for listed causes. You cannot renew if you no longer meet the initial license standards.

Lower fees and yearly licenses for distributors

Starting January 1, 2025, distributor licenses renew every year. The annual fee is $100 per cash device, capped at $5,000. This replaces the old $200 per device fee and the old $10,000 cap. Expect more frequent renewals, but lower per‑device costs for most.

Yearly licenses now for operators

Operators must renew their mechanical amusement device license every year, not every two years. The law does not set a new fee here. Expect more frequent paperwork and small costs.

Updated device definitions and coverage rules

The law updates what counts as a cash device and a mechanical amusement device. It covers machines that award cash, gift cards, credit, or items redeemable for value. It lists covered and excluded machines, like skill games included and home‑use devices excluded. Covered machines must follow licensing and fee rules.

Yearly license and lower fee for manufacturers

Manufacturers now renew their cash‑device license every year. The license fee is $5,000. This replaces the prior $10,000 fee. Paperwork happens more often, but the fee amount is lower.
