Easier state contracts with new exceptions

The state purchasing division now allows limited exceptions to some bidding rules. The Director of Administrative Services reviews these decisions. Exceptions cover sole-source and emergency buys, GSA-priced items, and contracts already bid by another state or a buying group. Agencies can approve other exceptions when standard rules do not fit, but they must keep a written reason on file. Many contract types are outside these bidding sections. Examples include consultant selection under the state act, legal and hearing services, grants and cooperative agreements, intergovernmental deals, and contracts up to $15,000,000 for direct medical, behavioral, or developmental care to one person. It also exempts Department of Natural Resources water infrastructure projects, Department of Transportation road and bridge work, and certain agreements with the University and other state entities.

New rules for public bid openings

Agencies must set the closing hour for bids. Bids are opened at that hour, all at once, with bidders or their reps present. Agencies may keep bid details private until they post an intent to award. If several contracts are opened together, each contract may be awarded as its bids are opened.
