Alternate bidding for parks and water projects

Projects under the State Park System Construction Alternatives Act use that act’s rules instead of public lettings. Projects under the Public Water and Natural Resources Project Contracting Act also use that act’s rules. Work covered by sections 39-2808 to 39-2823 follows those sections, not the general letting rules. The Department of Natural Resources is exempt from sections 73-807, 73-815, 73-816, and 73-817 for all water infrastructure contracts. Contractors on these projects follow the specialized selection steps set in those laws.

Bids stay sealed until intent to award

The law sets the exact closing time for bids and requires opening them then, in front of bidders. Agencies can keep bid contents confidential until they issue an intent to award. If many contracts open at once, officials may award each as bids are opened. This protects bidders’ pricing strategies but reduces instant public access to bids.
