The law defines opioid overdose reversal medication to include any FDA‑approved drug, such as naloxone and nalmefene. It applies whether the drug is prescribed, given by a health professional, or bought over the counter. It also defines who counts as health professionals, emergency responders, peace officers, and law‑enforcement employees for these protections.
The law shields EMTs, paramedics, and other emergency responders who, in good faith, use overdose‑reversal drugs supplied by their EMS employer. They are not subject to job discipline or criminal charges and are not personally liable for damages unless their actions are willful, wanton, or grossly negligent. Peace officers and law‑enforcement employees get the same protections when using drugs supplied by their agency. The employer or agency’s own liability is not changed.
The law protects licensed doctors, physician assistants, nurse practitioners, and pharmacists who act with reasonable care when they prescribe, give, or dispense opioid overdose drugs. It also protects family, friends, school staff, and other laypeople who act in good faith to get the drug by prescription or over the counter and give it during an overdose. These people face no criminal charges or professional discipline for doing so. Covered drugs include FDA‑approved overdose antidotes like naloxone and nalmefene.
