Businesses shielded from most cyber class actions

The law shields private businesses and nonprofits from class-action lawsuits over a cybersecurity event, unless they acted with willful, wanton, or gross negligence. A cybersecurity event means unauthorized access to, or disruption or misuse of, an information system or the nonpublic information on it. Nonpublic information means personal data linked to an identifier plus a Social Security number, driver’s license or state ID number, a bank or card number, a financial access code or password, or a biometric record. The law also defines who counts as a private entity and what publicly available information means. An information system includes electronic data systems and specialized systems like industrial controls, telephone switching, and environmental controls.
