Beginning July 1, 2025, the petroleum cleanup fund only reimburses releases first reported after July 17, 1983 and on or before June 30, 2028. It can pay cleanup costs by the responsible person or by the department. It also covers damage the department causes while investigating or doing the cleanup. Releases first reported outside that window are not eligible.
Starting July 1, 2025, the state splits disposal fees 50/50 between two funds. The Integrated Solid Waste Management Cash Fund share falls from 65% to 50%. The Waste Reduction and Recycling Incentive Fund share rises from 35% to 50% to support recycling grants and some cleanup reimbursements. Rebated fees count when figuring total fees, but the rebated amount is not credited to the recycling fund. The department may sue to recover costs it pays from the integrated fund.
Beginning July 1, 2025, the disposal fee drops from $2.00 to $1.3425 per unit. A unit is each 6 cubic yards uncompacted, 3 cubic yards compacted, or per ton of waste. Permitted landfills and solid waste processing facilities pay the fee each quarter, due 45 days after the quarter ends. Late payments accrue interest at the statutory rate. Sites used only for reclamation by landscaping rubble or inert material are excluded.
The law allows up to $1.5 million each fiscal year through June 30, 2025 from the petroleum cleanup fund for federal Superfund cost‑share and operations. Any investment earnings dated April 16, 2024 or later are credited back to the fund. The Legislature can direct transfers from this fund to the Superfund Cost Share Cash Fund. These changes adjust how the fund is financed and used; they do not set new fees.
