Local governments can use land use or inclusionary housing rules to add affordable homes. They can also run programs where an owner signs a contract to limit rent or rent increases. These actions are allowed and are not treated as rent control under the state ban. Owners only face limits if they choose to opt in.
Cities, villages, and counties cannot pass or enforce rent control on private property. This applies even in home rule cities. Any local rule that conflicts is null and void. The ban has narrow exceptions allowed by state law, including affordable housing land use rules and voluntary, contract programs.
