Easier group health coverage via PEOs

For small‑employer health rules, a PEO counts as the employer for its covered workers. When a single PEO sponsors the plan, insurers must accept and insure all employees and beneficiaries who meet the plan’s eligibility rules. Both the PEO and the client are treated as employers for retirement and welfare plans. A fully insured plan that covers only one PEO’s employees is treated as one plan and does not have to register under the state Multiple Employer Welfare Arrangement law.

Stricter rules for PEO co-employment

The law sets a floor for co-employment in Nebraska. You cannot use a PEO co-employment unless covered employees are a majority of your Nebraska staff, or at least half of your Nebraska payroll. In a co-employment, the client keeps employer rights and duties unless the law or the written PEO agreement says otherwise. The client directs daily work and stays responsible for operations, fiduciary duties, and licenses. The PEO may do only what the law or contract names.
