Penalty for breaking ad disclaimer rules

Anyone who knowingly breaks these disclaimer rules commits a Class IV misdemeanor. This criminal penalty applies only to knowing violations.

Stronger paid-for-by rules for political ads

The law requires most political ads to say who paid for them. For printed items about a candidate or ballot question, the payer’s name and street address must appear. This does not apply when an individual pays on their own with personal funds. If the candidate pays, printed items must show the candidate’s name and street address or P.O. box. For radio and TV ads, the ad must say the payer’s name unless an individual pays on their own with personal funds. If the candidate pays, the ad must name the candidate. Stations must keep the payer’s street address on file for at least six months and give it to anyone who asks. For candidate-paid ads, stations keep the candidate’s street address or P.O. box. The Nebraska Accountability and Disclosure Commission sets size and placement. Rules do not require disclaimers on windshield stickers, yard signs, bumper stickers, campaign buttons, or balloons. The commission can also exempt other items printed at a candidate’s or committee’s request.
