Certain statutes repealed, some in 2026

The law removes listed statutes from the books. Some take effect immediately. Sections 38‑206, 71‑7105, and 71‑7106 are repealed on July 1, 2026, and Section 74 becomes operative that day. The practical effects depend on what those repealed sections previously did.

Emergency planning duties move to NEMA

The State Emergency Response Commission ends July 1, 2026. Starting that day, the Nebraska Emergency Management Agency carries out emergency planning and right‑to‑know duties. This keeps core public safety work in place under NEMA.

Aquaculture board for fish farms

The Nebraska Aquaculture Board is created to support fish farming. Members have three-year terms and can be reimbursed for expenses. The creation section ends July 1, 2026.

Climate assessment response committee created

A climate committee in the Governor’s office meets at least twice a year and can form subcommittees. It can receive funds if appropriated and may reimburse members’ expenses. The committee and related sections end July 1, 2026.

Rural broadband task force and fund

The state creates a Rural Broadband Task Force to study access, adoption, and cost in rural areas. Members serve two-year terms and report findings to lawmakers. A fund supports the task force with appropriations and gifts. The task force and fund end on July 1, 2026, and any money left goes to the General Fund.

Children's behavioral health and foster panels

A Children’s Behavioral Health Task Force brings courts, providers, and lawmakers together to improve kids’ behavioral health. Members get expense reimbursement from the Nebraska Health Care Cash Fund. A Bridge to Independence Advisory Committee also helps oversee services for youth leaving care and reports each year by September 1. Both groups end July 1, 2026, and the Children’s Commission then carries on the Bridge to Independence duties.

Women’s health advisory council created

A Women’s Health Initiative Advisory Council is created with up to 30 members. At least three-fourths of members are women. The council is advisory and ends July 1, 2026. It does not change who qualifies for care or add funding by itself.

Natural gas vehicle fuel board

A Natural Gas Fuel Board now advises the state on using natural gas for motor vehicles. It reviews distribution, fueling sites, workforce needs, and possible loans, grants, and tax incentives. The board has eight governor appointees and ends July 1, 2026.

Human trafficking posters at certain venues

Rest stops, strip clubs, and casinos must post human trafficking help posters. Posters must be in English, Spanish, and other needed languages. They must list a toll-free number, preferably (888) 373-7888. The Department of Labor works with the state task force and gets this in place by July 1, 2026.

Fees and fund for career schools

Private postsecondary career schools pay set fees into a new cash fund. An initial application costs $200 plus $20 per program. Fees are not refundable. Each year, the board sets fees to cover admin costs, capped at 110% of last year’s total admin cost.

Aquaculture statutes end July 2026

Sections 2‑5001 to 2‑5006 that governed aquaculture end on July 1, 2026. Aquaculture operators lose that statutory program and its rules on that date.

Potato programs end; laws reorganized

On July 1, 2026, the Nebraska Potato Development Act and the Nebraska Potato Development Committee end. The law also directs a merger of potato statutes into one act, an editorial step that ends July 1, 2026. Potato growers and related businesses lose the prior state program framework.

Breast and cervical advisory panel ends

The Breast and Cervical Cancer Advisory Committee ends July 1, 2026. This removes a formal advisory group. The law does not change eligibility or coverage for clinical services.

Human trafficking training set; task force ends

The task force develops mandatory training on trafficking laws, spotting victims, interviews, work with nonprofits, and victims’ rights. It must seek nonprofit input before July 1, 2026. The task force ends on July 1, 2026. These steps aim to improve public safety while the standing task force closes.

Old broadband policy statement repealed

The law removes a prior broadband findings section on July 1, 2026. This changes policy language only. It does not change service rules or funding by itself.

Road superintendent oversight moves to one board

Starting July 1, 2026, one board oversees the County Highway and City Street Superintendents Act. The Board of Public Roads Classifications and Standards takes this role and the term “Board of Examiners” now points to it. The old Board of Examiners ends on July 1, 2026.

State IT panel ends; commission takes over

On July 1, 2026, the meaning of “technical panel” in law shifts to the commission. The Nebraska Information Technology Commission takes over the panel’s duties. The technical panel ends on that date. This is an internal change in who runs IT standards and reviews.

DHHS runs Critical Incident Stress program

Beginning July 1, 2026, DHHS coordinates the Critical Incident Stress program, staffing, training, and budgets. DHHS appoints the statewide clinical director and sets how regions operate. Regional clinical directors must have a graduate degree in a mental health field. These steps aim to improve support for responders while setting new credentials for leaders.

Foster care oversight moves to Commission

Starting July 1, 2026, the Nebraska Children’s Commission takes over foster care rate review and Bridge to Independence advisory work. The Foster Care Reimbursement Rate Committee ends on that date. This centralizes oversight but does not itself change payment amounts.

State vacant property oversight shifts to DAS

Starting July 1, 2026, the Department of Administrative Services runs vacant building and excess land rules. The Vacant Building and Excess Land Committee ends that same day. This is an internal shift and does not change taxes or household benefits.

Early Childhood Council membership changes

Beginning July 1, 2026, the Early Childhood Interagency Coordinating Council has 16 governor‑appointed members. Parents and key education, health, child care, and Head Start voices must be included. Members serve three‑year terms, can serve up to two in a row, and get expense reimbursement under state law.

Nursing and mental health boards reorganized

Beginning July 1, 2026, the Board of Nursing takes over advanced practice nursing duties. The Board of Advanced Practice Registered Nurses and the Board of Alcohol and Drug Counseling end on that date. Statutes that said “board” for these areas now point to the Board of Nursing or the Board of Mental Health Practice, as specified. The Board of Nursing gets new duties to set APRN practice rules and standards. Its membership shifts to 10 registered nurses, 2 practical nurses, and 3 public members, with preferred APRN seats (CRNA, NP, CNS, CNM) and staggered APRN terms ending Dec 1 of 2028–2031. Another licensing board gains two licensed alcohol and drug counselor seats. Past board actions remain valid when names change.

Propane council expanded through July 2026

The Propane Education and Research Council grows to nine members with set industry and public seats. Governance rules apply, and this section ends July 1, 2026. This changes council makeup, not taxes or consumer fees.
