Opt-out HIV and syphilis tests in pregnancy

Prenatal providers must test for syphilis at the first visit, again in the third trimester, and at birth. The syphilis test is voluntary, and you can decline in writing or by telling your provider. Providers also give an HIV test during pregnancy unless you sign a written form to opt out. You must be told the HIV test is voluntary, and you can decline verbally or in writing. Tests must use a state‑approved lab, and results are reported to Nebraska’s health department. Birth and stillbirth certificates show if a syphilis test was done and the date, not the result; if no test, the reason is listed. The department may charge a fee to cover the actual cost of testing. The older version of this law is repealed.

Medicaid covers prenatal syphilis blood test

If you are on Nebraska Medicaid, the syphilis blood test under this law is paid when it was not covered before the law took effect. The state uses the Medicaid Managed Care Excess Profit Fund and federal funds to pay for it.
