New checks and fines for gaming businesses

On the date set by the Tax Commissioner, gambling operators must check the state system before paying any winnings. Failing to check or collect can bring fines up to $10,000 at racetracks and can count as a license violation for Department of Revenue–licensed operators. Most cash‑device operator or distributor license applicants must pass a one‑time background check and pay the cost; holders of a liquor license are exempt. Individual applicants must provide a Social Security number.

State system to collect debts from winnings

The Department of Revenue builds a secure system to match winners to debts. It shows the total owed, not the debt sources. DHHS can submit certified debts of $25 or more. The Department of Revenue, DMV, and Department of Labor can submit outstanding state tax debts. Agencies can write rules to run the program. Submissions are ongoing, except when a debt is in dispute.

Paid sick time coverage and pay

Employers with 11 or more employees are covered by the paid sick time law. A small business is 11 to 19 employees, but not if it kept 20 or more employees for 20 or more weeks in the current or last year. Paid sick time is paid at your usual hourly rate, at least the rate set in section 48-1203. If you are paid by commission, piece, mileage, or fee, your employer converts your average weekly pay to an hourly rate by dividing by 40. People who work in Nebraska fewer than 80 hours in a year are not covered.

Unemployment overpayments from winnings and benefits

If you were paid unemployment benefits you were not entitled to, the state can take your gambling winnings. The state can also sue, take tax refunds, or withhold from future benefits within three years of the benefit year. If you were not at fault and withholding would defeat the law’s purpose or be against equity and good conscience, the state does not withhold future benefits.

Gambling winnings used to pay debts

Starting on the date the Tax Commissioner sets, operators must check a state system before paying winnings. If your name is in the system, that lookup is a lien and the operator takes the full identified debt from your winnings. The operator sends the money to the Department of Revenue; DHHS child‑support debts are paid first, then state taxes on a pro rata basis. The Department of Revenue or DHHS must notify you within 20 days and give you 30 days to contest in writing. Your written contest counts when you mail it, and you can get a hearing and appeal.

Home and building elevator inspection rules

Before first use of a new elevator or similar device installed after January 1, 2008, owners must get a State Fire Marshal inspection certificate, have the contractor register the installation, and display the certificate. You may use an inspection by a licensed insurance company representative or approved third‑party and pay an administrative fee instead of a state inspection; a qualifying city inspection can also substitute. In counties with over 100,000 people, home elevators are inspected at installation but are not subject to periodic inspections.

Elevator safety standards and licensing

The State Fire Marshal sets safety rules using national standards, reviews them each year, and may grant variances only if safety is not reduced. You can appeal decisions. The Marshal hires qualified elevator inspectors and may add deputies. Anyone can request an investigation; your contact info stays private during the initial inquiry. Elevator mechanic and contractor license applications must include a Social Security number, experience, insurance, and accident history, and allow a criminal‑history check; Social Security numbers are not public.
