Medicaid now funds some syphilis tests

For Medicaid members, when a syphilis blood test was not covered before this law, its cost is paid from a state fund and federal funds. The state uses the Medicaid Managed Care Excess Profit Fund along with federal money. This lowers out-of-pocket costs for those tests.

Prenatal syphilis and HIV testing rules

The law requires your provider to test for syphilis at your first prenatal visit, again in the third trimester, and at birth. Samples must be sent to an approved lab. You must be told these tests are voluntary, and you may decline verbally or in writing. For HIV, the test is not given if you sign a written refusal. Labs and doctors must report results to the Nebraska Department of Health and Human Services on standard forms. For each birth or stillbirth, the medical part of the certificate must state if a syphilis test was done and the sample date, but not the result; if no test was done, the reason must be given.

State lab testing with capped fees

The state health lab will run the required prenatal syphilis tests if asked. The department can charge a fee, but it cannot be more than the test’s actual cost. Fees are deposited in the Health and Human Services Cash Fund. Patients without insurance may be charged this fee.
