Transfer-on-death deeds must now include clear warnings. The deed must warn about Nebraska inheritance tax, possible personal liability for Medicaid payback and estate costs, and that DHHS can require revocation to qualify for Medicaid. You must record the deed in the county register of deeds within 30 days after you sign it and before you die. Minor mistakes in the warning wording do not void a recorded deed. Any lawsuit over missing disinterested witnesses must be filed within 90 days after the transferor’s death (or the last surviving transferor). For deaths before May 8, 2013, the deadline is the later of 90 days after death or 90 days after May 8, 2013. The law also repeals older sections and consolidates these rules in one act.
After the owner dies, a transfer-on-death beneficiary is treated as insured on the home policy. Coverage lasts until the policy period ends, the beneficiary gets their own policy, or 30 days after death if any required extra premium is paid. New deeds must warn that coverage can end on those timelines. Existing insured household members keep their coverage. The beneficiary does not get any insurance money that accrued before the insured died.
