Beginning January 1, 2026, if your insurance covers medically necessary epinephrine injectors, you pay no more than $60 for a two‑pack. Plans can charge less. The cap does not apply to specified-disease or other limited-benefit policies. If you have an HSA-eligible plan and have not met the IRS minimum deductible, the cap starts after you meet that deductible. Preventive care coverage still applies. Self-funded employer plans must follow this unless federal law blocks it.
Nebraska’s health and education departments create a model plan to handle severe allergic reactions in schools and licensed child care. The model covers treatment steps, individual health plans, how to talk with families, and ways to cut risk. Agencies review and update it at least every three years and post it online. By July 1, 2026, each school board must have a written anaphylaxis policy in handbooks that does not conflict with a student’s individual plan. Licensed child care that serves a child with a known allergy must also have and publish a written policy by July 1, 2026. Programs and districts may use the state model. A policy already in place before this law counts.
The law repeals section 71-1908 of Nebraska statutes. This is a technical change to child care licensing law. The direct effects for households are unclear without the prior text.
