More Medicaid pay for nonhospital care

The state creates the Medicaid Access and Quality Fund and keeps its interest in the fund. Starting January 1, 2026, $40 million a year is used to get federal match and raise Medicaid rates for nonhospital physical health providers. The state cannot use this money to replace current funding. DHHS must file for federal approvals by August 1, 2025 and can set rules to run the program. Medicaid practitioner rates and state funding cannot drop below the amounts published on July 1, 2024.

New premium taxes on HMOs and prepaid plans

Beginning January 1, 2026, HMOs that sell non‑Medicare plans pay a 6% tax on those premiums. This new tax is on top of the existing insurance premium tax. Capitation payments under the Medical Assistance Act are not counted in the taxable premium base. Prepaid limited health service organizations are taxed the same way and get the same tax breaks. The Director of Insurance sets the collection schedule by January 1, 2026, and all receipts go to the Medicaid Access and Quality Fund.

Immediate effect and cleanup of old laws

The law takes effect when it is passed and approved because an emergency is declared. It also repeals older statute sections that this act replaces.
