City gas deals for big factories

The law lets Nebraska cities of the first or second class and villages that run gas systems use tax‑exempt gas supply deals allowed under federal rules as of January 1, 2024. Through January 1, 2027, they can sign contracts to sell gas to an industrial customer in Nebraska within 100 miles. The customer must need at least 3,000,000,000 BTU of gas per day on an annual average. The customer cannot be a current customer of a competitive gas provider and must not have received service from any investor‑owned or government gas system in the past five years. Contracts must last at least two years and can include renewals, and delivery must go through a competitive provider registered in Nebraska. Before signing, the city or village must pass a resolution that the deal does not pose an unreasonable financial risk to it or its taxpayers, and the facility is treated as inside the city or village gas service area.
