The law requires all automotive spark-ignition fuel sold in Nebraska to meet ASTM D4814-24b. This covers gasoline and blends with oxygenates like alcohol and ethers. The Department of Agriculture files copies of the standard with the Secretary of State and the Clerk of the Legislature. This rule has applied since January 1, 1992.
Selling fuel that does not meet the ASTM standard is a crime in Nebraska. A first offense is a Class I misdemeanor. Later offenses are Class IV felonies. These penalties have applied since January 1, 1992.
