Licenses and compliance staff for kiosk operators

Kiosk operators must hold a license under the Nebraska Money Transmitters Act. Each operator must employ a full-time compliance officer who owns no more than 20% of the company. Compliance work must be done by full-time staff or approved vendors supervised by full-time staff. Operators must report each kiosk as an authorized delegate and file a quarterly list of all kiosk addresses within 45 days after each quarter.

Refunds and clear warnings at digital kiosks

If you report fraud to the operator and to law enforcement or a government agency within 30 days, you can ask for a refund. New customers get a full refund including fees; existing customers get the fees back. Kiosks must show clear disclosures in your chosen language, a strong fraud warning, fees, exchange rates, limits, and contact info. You get a receipt with the transaction hash and addresses. Live toll-free help is available Monday–Friday, 7 a.m. to 9 p.m., and the number must be on the kiosk.

Search warrants cover digital records, too

Controllable electronic records count as “property” for search warrants. Police can seek and seize them with a warrant under the same rules as other listed items. Constitutional search protections still apply.

Daily limits and fee caps at kiosks

New customers are limited to $2,000 per day across all kiosks in Nebraska. Existing customers are limited to $10,500 per day. Operators must block sales that go over your daily limit. All fees and markups for a transaction or related series cannot exceed 18% of the U.S. dollar amount.

Fraud warnings required where gift cards sell

Stores that sell gift cards or gift certificates must post a clear fraud warning where cards are shown or at checkout. The Attorney General provides model wording. The first citation is a warning; later citations can bring civil penalties up to $250. Cards redeemable only at the same business and general-use prepaid cards from financial institutions are exempt.

Anti-fraud tech and law-enforcement contact

Kiosk operators must use blockchain analytics to avoid sending purchases to wallets known for fraud at the time of the sale. They must keep a written antifraud policy, assign responsibilities, and review it regularly. Operators must maintain a dedicated law-enforcement contact, check it at least daily, and post it on their website.
