The law treats controllable electronic records as property for search‑warrant rules. Law enforcement can describe and seize these records under the same warrant process as other property.
The law requires kiosk operators to be licensed money transmitters and to register each kiosk as an authorized delegate. Within 45 days after each quarter, operators list each kiosk’s CER addresses and use blockchain analytics to block risky wallets. Each operator employs a full-time compliance officer (owns no more than 20%) and keeps a written anti-fraud policy. Operators provide live toll‑free support Monday–Friday, 7:00 a.m.–9:00 p.m., and post a daily‑monitored law‑enforcement contact online. Before a sale, operators give clear disclosures in the customer’s language, get consent, and issue detailed receipts after.
You cannot use a kiosk to move more than $2,000 in a day as a new customer. Existing customers are capped at $10,500 per day. Total fees for a single transaction or related set cannot exceed 18% of the U.S. dollar amount. If fraud tricks you into a transaction, report it to the operator and law enforcement within 30 days. New customers get a full refund with fees; existing customers get their fees back, on request.
Sellers must post a clear gift card fraud warning where cards are sold or at checkout. The Attorney General publishes model notice language that sellers can use. The first citation is a warning; later citations can bring a fine up to $250. Single‑merchant gift cards are exempt. Bank‑issued general‑use prepaid cards used at many stores or ATMs are exempt.
