Farms protected; some buildings exempt from codes

The law protects existing farms and livestock operations in the extraterritorial area from city or village rules that would stop or interfere with their work. It also protects existing businesses or industry there. A board of adjustment can exempt a farm building from zoning, building, electrical, and plumbing codes in that area. The farm must be at least 20 acres and produce $1,000 or more a year. The building must fit the comprehensive plan, and the board must approve.

City rules now apply beyond city limits

The law lets cities apply their zoning, building, electrical, and plumbing codes outside city limits when adopted by ordinance. For first-class cities, this reach is two miles from the city line. For second-class cities and villages, it is one mile. For some state utility laws, the reach is smaller: one mile for first-class cities and one-half mile for second-class cities and villages. If your property sits in these bands, you must follow those city rules.

Counties get notice on nearby zoning

A city must send the county board written notice at least 30 days before a final decision on a zoning ordinance that affects the extraterritorial area. The county can send comments within 30 days. The city can decide after the 30 days, or sooner if it gets comments earlier. This notice rule does not apply in counties with more than 100,000 people or where the city and county share a joint planning commission or department.
