When the county decides on a conditional use or special exception, it presumes you will meet all laws. Challengers must provide facts to prove otherwise; without proof, the county approves. The county cannot require other agencies’ permits to grant the county permit. You still must follow state and federal rules and get any permits those agencies require. The county may ask reasonable information before deciding. After setting conditions, it may hold final approval only to check for big changes or that you meet the conditions. Big changes include moving buildings, changing waste methods, or raising capacity.
County attorneys, planning commissioners, and county board members in counties with zoning must take two hours of training each term. The training covers their role in zoning matters under this law. The law does not say who pays for the training.
If you apply for a livestock operation listed in county zoning on ag-zoned land, you can ask for the special conditions. The county must give that determination in a timely way. The county may require documents or data that you also submit to state or federal agencies. This can add paperwork when you apply.
