Stronger penalties for license violations

The board can discipline violations after a hearing and a two‑thirds vote. Penalties can reach up to $10,000 per offense. The board can suspend or revoke a license and order you to stop work. It can also make you pay investigation, hearing, and attorney costs. Civil penalties go to the State Treasurer; costs go to the Board’s cash fund.

Easier paths to a landscape architect license

The law updates how you get a landscape architect license. If you have a LAAB‑accredited (or board‑approved equivalent) degree and pass the exam, you can apply. You must show at least three years of post‑degree experience under a licensed landscape architect and provide references; the board can accept a CLARB council record. The board can use CLARB exams and grading, your license takes effect the day it is issued, and Nebraska licenses qualified out‑of‑state and 15‑year practitioners who show good character. Anyone licensed on November 14, 2020 stays licensed until the certificate expires.

What work needs a licensed landscape architect

The law explains what counts as landscape architecture and what does not. Licensed landscape architects handle site planning, grading, drainage, planting, and similar work; building design and streets, utilities, and sewers stay with architects, engineers, or surveyors. Some people do not need a license: supervised employees; in‑house staff working on employer‑owned, non‑public sites that do not risk public safety; other licensed pros working within their own license; and property owners working on their own land. Nurseries and landscape designers can use trade titles like “landscape designer” or “landscape contractor,” give layout drawings, and design plant‑focused spaces, but cannot use the title “landscape architect.” City and county planners may do planning tasks if they do not use the protected title.

Public roster, replacement fees, exam privacy

The board keeps a public list of licensed landscape architects with names and last‑known addresses. It can charge a public‑records fee for copies and files the roster each year with the Secretary of State. If you need a replacement or duplicate certificate, the board can charge up to $50 per issuance. Licensing exam materials are not public records and are kept private.
