Faster child support reviews for jailed parents

When the noncustodial parent will be in jail for more than 180 days, the Department must start a review within 15 business days and mail both parents to request financial papers within 30 days. The Department must finish the review and tell both parents its decision within 120 calendar days. If it does not find a decrease is warranted, the jailed parent gets a conference within 30 days, in person or virtual. Parents may send extra written proof at least 10 business days before the conference, and the jailed parent may waive it at least 5 business days before. The Department makes a final decision within 30 days after the conference or waiver and sends notices to the facility and its administrator.

Standard notices and appeal in child support reviews

For reviews a parent requests or the Department starts, the Department must mail each parent a notice 30 days before the review and tell what financial papers to submit. After any review, the Department must tell both parents whether it will refer the case to a county attorney or authorized attorney to ask a court to change the order. Each parent has 30 days after getting the decision to ask the Department in writing to review that decision and include reasons and proof.
