If dynamic (surge) pricing is on, the app must clearly say so before you request a ride. It must make you confirm you understand surge pricing and show a fare estimate first. Dynamic pricing is banned for seven days after a Governor-declared emergency that affects transportation in the named areas. The Governor can add more limits on dynamic pricing during an emergency.
If you drive for a ride-hailing app in Nebraska, you may only give prearranged rides. You cannot be a participating driver for more than 12 hours in any 24-hour period.
Ride-hailing companies must file the prices they use in the app with the state commission. They must keep that filing current and charge only those filed prices. After each prearranged ride, the company must send you an electronic receipt. It must show where the trip started and ended, time and distance, the total you paid, and the driver’s first name.
The state removes the prior ride-hailing statute and replaces it with this law’s rules. The new provisions now govern ride-hailing in Nebraska.
Ride-hailing companies are not under the commission’s usual rate rules, unless this law says otherwise. In their apps, they can list rides as paid, free, or a suggested amount. This gives companies more pricing options while reducing traditional rate oversight.
