Bill Overview

Analyzed Economic Effects

6 provisions identified: 0 benefits, 3 costs, 3 mixed.

Prices for bulk records and subscriptions

Batch business‑entity info costs $15 per up to 1,000 entities; each extra 1,000 is $15. Electronic registration certificates cost $6.50 each. Full database subscriptions cost $300 weekly, $1,000 for a twice‑monthly service, or $800 monthly. Image access costs $0.45 per page, capped at $2,000 per request; the entire image database is $800 per month. UCC portal batch requests cost $2 per record, or $2,000 for 1,000 or more records. Bulk UCC data files cost $800 for an initial file, $800 per monthly update, or $300 per weekly update. Bulk extracts of effective financing statements are informational only and do not give buyers the protections that come with registering for the farm‑product list.

Set fees for certificates and oaths

A certified certificate with the state seal costs $10. Copies cost $1 per page. Taking an acknowledgment costs $10. Administering an oath costs $10.

Standard UCC filing and search fees

Filing a UCC record costs $14 if sent in writing or $11 by another approved method. Filing costs $100 when the debtor is a transmitting utility. A termination statement is free. Getting UCC information costs $5 in writing or $4.50 by other media. County clerks must charge the same amounts. Fees go to the Secretary of State Cash Fund.

E-file federal liens and small fees

Federal liens on real property can be sent to the Secretary of State electronically. The Secretary forwards them to the county register of deeds, and the lien is effective when the register files it. Federal liens on personal property may be filed electronically with the Secretary. A county certificate showing whether a lien is on file costs $1.50; copies cost $1 per page. Beginning July 1, 2001, the Secretary provides UCC‑style information and may charge the UCC fee schedule for certain federal‑lien notices filed on or after July 1, 1999.

New process for state tax liens

State tax liens on real property are presented to the Secretary of State, who sends them to counties for filing. A lien is effective when the register of deeds files it. Presentment can be by direct electronic input. Personal property tax liens are filed with the Secretary and entered in a central index. The uniform fee equals two times the county recording fee. The Secretary bills the Tax Commissioner or Commissioner of Labor monthly, and no payment is due at presentment.

Farm lien list fees and schedule

The Secretary of State keeps a master list of farm‑product liens. Buyers and other users can register each year to get it. Registration costs $30 per year, plus up to $200 per product list per year. The list comes at least every three months and no more than once a month, with set cut‑off dates. Lapsed or ended filings are removed before each release. The state seeks USDA certification and retires older sections of law to fit the new system. The Secretary keeps a record of who registered and which lists they got for five years.
