Bill Overview

Analyzed Economic Effects

3 provisions identified: 0 benefits, 2 costs, 1 mixed.

ID and purchase limits for ephedrine

You must be 18 to buy certain over-the-counter ephedrine products in Nebraska. You must show a valid ID, like a driver’s license, state ID, military ID, alien registration card, or passport. You cannot buy more than 3.6 grams in 24 hours or more than 9 grams in 30 days. Stores must keep these products behind the counter or in a locked case, and sellers must be 18 or older. Products must follow OTC monograph labeling and cannot be promoted as stimulants or for a high. Examples include Primatene Tablets and Bronkaid Dual Action Caplets.

Stricter rules on fentanyl-like drugs

The law adds many opioids, fentanyl analogues, and other listed drugs to Schedule I. Making, selling, or possessing these drugs now carries the strictest state controls. Items on the DEA exempted products list as it existed on January 31, 2022 remain excepted. Pharmacies, prescribers, manufacturers, and users are affected.

Updated prescription drug schedules and exceptions

The law updates the lists for Schedules II through V. It names prescription opioids and stimulants, ketamine, tramadol, and codeine or similar mixes that meet set milligram limits. It also covers veterinary products like Telazol and xylazine, with specific animal-care exceptions. Prescribers, pharmacists, manufacturers, and distributors must follow the revised rules and limits. The prior section is repealed and replaced with this updated version.
