Schools must share special education records before hearings

Beginning July 1, 2025, local school districts must share records early in special education due‑process cases. If the complaint is not resolved in the 30‑day resolution period, the district must let the parent, legal guardian, or surrogate inspect and copy all records it has about the child’s current or proposed program or placement. The district must provide them at least 5 business days before any prehearing conference. Records include federal eligibility documents; current and partial Individualized Education Programs (IEPs) from the last 3 years; proposed IEPs; prior written notices from the last 3 years; tests and reports that support those IEPs; and progress reports on IEP goals.
