New ways a DWI becomes aggravated

Beginning January 1, 2026, more situations count as aggravated DWI. A case is aggravated if you carry a passenger under age 16; drive a vehicle with a gross combination weight rating of 10,001 pounds or more; or drive in violation of RSA 265:26, I (the specific traffic rule named in state law). These factors count under both parts of the aggravated DWI law. Aggravated DWI carries tougher penalties than a standard DWI.
